Along with first degree murder, Derek has also been charged with burglary involving a gun from a military surplus store, and gun violations. There was no motive for the killing. The suspect is a 24-year-old college dropout, and has a history of mental illness including manic depression, and has been off his medication. The death penalty is being considered for him at the time being. The defense attorney says that Potts' mental illness will play a part in the case. The Capitol has no medical detectors and its guards are unarmed. After the incident safety measures were being looked into.
